Terms and Conditions of Service

 

• dmp3 Music™ converts various media into digital formats. This service is only available for conversion of media you are authorized or legally permitted to change in format. The resulting converted digital files can be used, copied, shared, or distributed only within the terms of current ‘fair use’ copyright laws. You agree to hold dmp3 Music harmless from any violation of copyright laws by your use of the service.

• dmp3 Music will not encode CD-Rs unless they contain properly copyrighted material and have been legally obtained by the client.

• The condition of the original media impacts dmp3 Music’s ability to successfully convert to digital files. Media containing copy protection devices will not be converted.

• dmp3 Music is not responsible for the content of the online CD databases used for ID tagging of digital music files.

• Shipments of CDs to and from dmp3 Music are insured based on current replacement or market value depending on the type of claim. However, dmp3 Music is not responsible for replacing physical CD collections, therefore the customer assumes all responsibility for insuring the personal value of their CD collection in a manner they see fit.

• dmp3 Music is not liable for any damages to equipment owned by the client, including but not limited to computers, hard drives and digital audio players.

• dmp3 Music is not liable for refund or credit of any kind for loss, corruption, delay, inclusion, omission, shipment, misdelivery, nondelivery, misinformation, other direct or indirect damages, or failure to provide converted materials or shipping services resulting from the clients acts, defaults, omissions, or violation of these Terms and Conditions of Service. At our option, we will either refund or credit the charges you paid for the services upon your request if we fail to properly provide the services or to properly ship the products, subject to limitations described above.

• You agree to indemnify, defend and hold dmp3 Music harmless from and against any and all claims, damages, losses, costs, and expenses that arise directly or indirectly from (a) your breach of any provision of these Terms and Conditions of Service; (b) any allegation that any materials you provide constitute Infringing Materials.

• dmp3 Music holds a backup copy of each customer’s library for 60 days after job completion, at which time the backup is automatically deleted. This is a courtesy extended to each customer so that they have ample time to backup their music and to review content/quality.

• All payments for orders are due prior to or upon final delivery.
